Terms of Service

These Terms of Service ("Terms") govern access to and use of the platform at brancmotiontalent.com (the "Platform"), operated by Branc Motion Talent ("Branc Motion", "we", "us", or "our"). By creating an account, submitting an application, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

The Platform is an internal management system Branc Motion uses to evaluate creator applications, manage its talent roster, coordinate influencer marketing campaigns with brand clients, and track the resulting deliverables, invoices, and payouts. It is not a public marketplace — access is by invitation or application approval only.

The Platform has three kinds of accounts, each with different access:

• Creators — talent represented by Branc Motion, who use the Platform to view assigned campaigns, submit content for review, and track earnings.
• Brand contacts — client-side users who review and approve submitted content and campaign progress for their own brand's campaigns only.
• Staff — Branc Motion employees who manage applications, campaigns, contracts, and finances.

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at talent@brancmotion.com if you suspect unauthorized access.

Being listed as "active" on the Platform reflects that Branc Motion currently represents you, but it does not by itself create or modify a representation agreement. The commercial terms of your representation — commission percentage, exclusivity, contract term, and similar — are governed by your separate signed representation agreement with Branc Motion. Where the Platform displays a commission rate, contract status, or contract dates, that display is for operational tracking and does not override your signed agreement if the two ever conflict.

When you upload video, photo, captions, or other material through the Platform for a specific campaign deliverable, you retain ownership of that content. You grant Branc Motion and the relevant brand client a limited license to review, comment on, and (once approved and published per the campaign brief) use that content solely for the purposes of that campaign, consistent with the usage rights set out in the applicable campaign agreement. You are responsible for making sure content you submit doesn't infringe anyone else's rights.

Brand contacts can see campaign, deliverable, invoice, and approval information relevant to their own brand's campaigns only. Brand contacts may not use content shared through the Platform for any purpose outside the scope of the agreed campaign, and may not attempt to access another brand's data or a creator's internal profile information.

The Platform records invoices, fees, commissions, and payout status for bookkeeping and transparency. It does not itself move money — payments between brands, Branc Motion, and creators are currently handled outside the Platform (for example by bank transfer), and a payout's status on the Platform reflects what staff have recorded, not an automated transaction.

You agree not to:

• Misrepresent your identity, follower counts, engagement, or other metrics in an application or profile.
• Attempt to access accounts, campaigns, or data that aren't yours.
• Use the Platform to upload unlawful, infringing, or harmful content.
• Interfere with the Platform's normal operation (including automated scraping, load testing, or bypassing access controls).
• Share your account credentials with anyone else.

Submitting a creator application does not guarantee representation. Branc Motion reviews applications at its discretion and may decline an application, or end representation of an existing creator, consistent with the applicable representation agreement.

We may suspend or terminate access to the Platform for any account that violates these Terms. Ending your Platform access does not by itself terminate a separate signed representation or campaign agreement — those end according to their own terms.

The Platform is provided "as is." We work to keep it accurate and available, but we don't guarantee it will be uninterrupted or error-free, and we're not liable for decisions made solely on the basis of Platform data without independent verification.

To the fullest extent permitted by law, Branc Motion is not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Nothing here limits liability that can't be excluded under applicable law.
